Effective upon approval, the law caps Health Department payments for medical care at Hawaii’s Medicaid fee schedule or the provider’s bill, whichever is lower. This covers Hawaii State Hospital patients and patients in the health director’s custody at another psychiatric facility. Medical care includes medical and dental exams, diagnosis, treatment, and supplies the department finds clinically necessary—not long-term care. The department may set separate long-term care rates when these patients are discharged to a long-term care facility. The law sets no long-term care rate. The department’s purchases of both types of care are exempt from chapter 103F state purchasing requirements. These changes do not themselves require patients to pay. Rights and duties already established, penalties already incurred, and proceedings already begun before the law took effect remain unaffected.
