More time for abuse survivors’ claims

For qualifying sexual abuse that happened before July 1, 2024, survivors can file a claim based on a later psychological injury within three years after discovering, or reasonably being expected to discover, its link to the abuse. The old deadline tied to the victim’s 18th birthday is removed. For abuse on or after July 1, 2024, the deadline is the later of 32 years after the victim’s 18th birthday or five years after discovering the link. The claims must involve sexual acts that were, or would have been, crimes under specified Hawaii laws.

Rules for repricing talks after 2029

Beginning July 1, 2024, the law sets transition rules for Act 234. When Act 234 is repealed on June 30, 2029, two state law sections return to the form they had before Act 234 took effect. Repricing negotiations that began before June 30, 2029, can continue after the repeal.
