Starting July 1, 2025, each foreclosed property must be offered separately unless the mortgage or deed requires a grouped sale. Any person, including the foreclosing mortgagee, can bid. Eligible tenants living in the property as their main home, qualifying buyers who plan to live there, affordable-housing nonprofits, community land trusts, and state or county agencies can make a later bid. A tenant cannot be the borrower or the borrower’s child, spouse, or parent. A prospective owner-occupant must provide an affidavit, move in within 60 days after the deed is recorded, and stay at least one year; they cannot be a close relative of the borrower or act as another buyer’s agent. The later bid must match or beat the latest highest bid. A bid or written notice of intent received within 15 days can delay finality; the sale becomes final no later than 45 days after the public sale. The successful bidder must make a nonrefundable down payment of at least 10% of the bid. If an eligible bidder wins later, the first bidder gets that down payment back.
