A new excessive-speeding conviction within five years of two prior convictions for the same offense is a misdemeanor. The person must serve at least 30 days in jail without probation or a suspended sentence, and their driving privileges are revoked for 90 days to six months. They must complete driver retraining and pay a $25 neurotrauma surcharge, a driver-education assessment, and a possible court-ordered surcharge of up to $100. The law no longer lists the former $1,000 fine. A court may also order the vehicle used in the offense forfeited, but forfeiture is not automatic.
