Beginning July 1, 2026, a pregnant person is not criminally liable for their own act or failure to act. An approved medical procedure by a licensed Iowa physician that ends or seriously injures a pregnancy is not a crime, at any stage. This protection applies even when the patient cannot give consent.
Beginning July 1, 2026, ending a pregnancy without the pregnant person's consent during a forcible felony is a class B felony. Ending a pregnancy without consent during another felony or by felonious assault, or intentionally without consent, is a class C felony. Attempts are a class D felony. Forcing or intimidating someone to consent is a class C felony. Causing an unintentional termination or serious injury by an act likely to cause it is an aggravated misdemeanor. Assault against someone the offender knows or should know is pregnant is a class D felony.
Beginning July 1, 2026, intentionally ending a pregnancy after the second trimester, with the pregnant person's consent, is feticide and a class C felony. Trying to do so is a class D felony. Anyone not licensed to practice medicine or osteopathic medicine who performs a termination commits a class C felony. A licensed Iowa physician may end a pregnancy to protect the life or health of the patient or fetus and must make reasonable efforts to preserve a viable fetus.
