Limits for people named to handle remains

Beginning 07/01/2026, a person named to control a decedent's remains can lose that authority. You lose control if you are charged with first- or second-degree murder or voluntary manslaughter in the death, and a third party knows about the charges. You also lose control if you do not act within 24 hours after you are told of the death, or within 40 hours of the death, whichever comes first. You also lose control if you do not claim cremated remains within 30 days after you receive a written notice from a third party. Control then passes to the backup named designee; if none, it goes to the next person in the state's default order.
