Fair coverage for out-of-network primary care referrals

Beginning July 1, 2026, if you have a direct primary care agreement with an out-of-network primary care provider, your plan cannot deny covered care just because the referral came from that provider. Your deductible, coinsurance, and copays for the referred care cannot be higher than for an in-network referral. Your insurer can ask your doctor to provide proof of your direct primary care agreement, by attestation or a copy. The Insurance Commissioner can set rules to enforce these protections.
