Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 2 costs, 1 mixed.

Defendants’ release evaluations require verified information

Beginning July 1, 2026, Iowa Department of Corrections evaluators must verify all information in a pretrial release evaluation. They must finish this check before giving the evaluation to a magistrate. The requirement covers evaluations prepared for magistrates to consider before a defendant’s release.

Defendants face tighter bail payment rules

Beginning July 1, 2026, Iowa magistrates must set bail at the warrant amount or, when applicable, at least the uniform bond schedule amount. They must consider other warrant conditions and give written reasons for bail below the schedule or set as a percentage. The law also requires written reasons for specified release decisions and conditions. Appearance-bond deposits in cash or other approved security are no longer capped at 10% of the bond amount. The law sets no replacement percentage cap, so some defendants may need more money upfront.

Fewer defendants qualify for release without bail

Beginning July 1, 2026, Iowa limits release on a defendant’s promise to return to court. Only defendants charged with a nonviolent, nondrug simple or serious misdemeanor qualify for this ordinary release option. Defendants may still be released for needed medical care. They must return to law-enforcement custody when medically cleared and fit for confinement. Defendants not released on bail remain in custody until brought before the magistrate who issued the warrant.

Broader bond schedule use, inflation update required

Beginning July 1, 2026, Iowa magistrates may use the uniform bond schedule whether or not courts are in session. It remains unavailable for arrests under Iowa Code sections 708.6 or 724.26(1), or for a forcible felony. The Iowa Judicial Council must update the schedule for inflation since the previous update took effect July 1, 2017. It must send the revised schedule to the Iowa Supreme Court by July 1, 2027. The law gives no new bond amounts; the inflation update may raise amounts for some defendants.
