Iowa courts weigh more factors after insanity acquittal

Beginning July 1, 2026, Iowa courts change how they judge danger after an insanity acquittal. Judges cannot base the decision only on no recent violent acts. This holds even when the person is in a hospital or secured facility. Courts must look at the original crime and any past violent or dangerous acts. They must review the person’s mental health, treatment history, and treatment adherence. They must also consider substance use history, relapse risk, and willingness to seek treatment. They review institutional behavior, ability to function outside, the effect of structure, and expert risk reports, including limits. The revised rule goes to the legislative council by October 14, 2026.
