Fines for transmission owners who break rules

Beginning July 1, 2026, the utilities commission can fine a transmission owner that violates this law or rules under it. The fine is up to $1,000 per violation or up to $10,000 per day for a continuing violation, whichever is greater. Penalties are payable to the commission.

Emergency plans and outage reporting by transmission owners

Beginning July 1, 2026, owners of high‑voltage lines (200 kV or more) approved on or after July 1, 2022 in a federally registered regional plan must plan and coordinate for emergencies. They must file an emergency response plan with the utilities commission by December 31, 2026, then update it yearly or within 30 days after major changes. Plans must list at least two 24‑hour contacts and update contact info within 24 hours when it changes. Plans must also set steps to notify state and local emergency managers and nearby utilities, explain staging and mutual aid, and show how they will restore essential sites first (hospitals, water plants, public safety). If an outage is expected to last more than six hours and meets the commission’s significant‑interruption rule, the owner must notify the commission with the cause, affected area and franchise, damage, and estimated restoration time, and send updates. During a governor‑declared disaster emergency, owners must coordinate repairs and share information with the commission and the Department of Homeland Security and Emergency Management. Plans are confidential except when shared to coordinate a response.
