Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Faster small-estate transfers up to $100K

Beginning July 1, 2026, you can use a small estate affidavit if the estate has only personal property worth $100,000 or less. There must be no real estate interest. Wait at least 40 days after death. A successor, as the law defines, can use the affidavit to collect one or more items. For some deaths before 2025, a joint-tenant exception applies. Also, Child Support Services must provide a form so a successor can claim undistributed child support the agency holds.

New rules for payable-on-death accounts

Beginning July 1, 2026, state banks honor who you named on a payable-on-death deposit account. After payment, that money still can be used to pay the dead person’s debts. For deaths before January 1, 2025, Iowa inheritance tax can still apply. The bank is not liable to creditors or for state estate or inheritance taxes after it pays the named person.
