Adults 18 or older, who are not the child’s parent or guardian, commit a crime by knowingly giving or showing obscene material to a minor. The rule covers displays a minor can see, on or off the premises. A first offense is a serious misdemeanor. A second offense is an aggravated misdemeanor with a mandatory minimum of one year in confinement, which cannot be deferred or suspended. A third or later offense is a class D felony with a mandatory minimum of three years, which cannot be deferred or suspended. These rules start July 1, 2025.
Beginning July 1, 2025, a person under 18 who knowingly distributes obscene material to another minor commits a serious misdemeanor. The text describes this as distributing “unofficial obscene material.”
