New safeguards for who controls remains

Beginning July 1, 2025, Iowa tightens who may control a person’s remains and funeral plans. A person barred under state law cannot serve as the decision-maker. A named designee loses authority if they are charged with first- or second-degree murder or voluntary manslaughter in the death and those charges are known to a third party. A designee also loses authority if they do not act within 24 hours of notice or within 40 hours of the death, whichever is earlier. In these cases, control passes to the alternate designee or, if none, the next person in Iowa’s default order.
