Beginning July 1, 2025, when an officer-involved shooting causes death or serious injury, the county attorney must review the case. They must choose one: issue a written opinion with a charging decision, convene a grand jury, or refer the case to the Iowa Attorney General. The county attorney must send a written report on the results to the officer (or the officer’s lawyer) and the officer’s agency within 180 days after receiving the evidence. If there is a conflict of interest, the review must go to an independent county attorney, the Attorney General, or a special prosecutor. The law uses the same meaning of “officer” as in Iowa Code section 801.4(11).
