When a court gives legal custody of a child to the Department of Human Services, the Department can consent to emergency care. It can also consent to routine medical care and to the child’s individualized education program (IEP). Routine care includes wellness visits, nonemergency exams and lab tests, and needed medicines like antibiotics, but not vaccinations. The Department may delegate these consent rights to a licensed caregiver. If Senate File 582, House File 757, or a successor is enacted by July 1, 2025, it may also delegate to an approved kinship caregiver. When it delegates medical consent, the Department must notify the caregiver and the child’s parents or guardians; for IEP consent, it must also notify the Department of Education. Beginning July 1, 2025, these rules apply only if one of those bills is enacted by that date; otherwise, a similar framework applies but delegation is limited to licensed caregivers.
