Age checks for explicit online content
Beginning July 1, 2026, Iowa requires age checks for covered websites, apps, and their sections to protect people under 18. Coverage starts when material pornographic for minors makes up at least 33% of a site's or app's publicly available data. That material must appeal to minors' sexual interests, depict nudity, sexual content, or sadomasochistic abuse offensively under community standards, and lack serious literary, artistic, political, or scientific value for minors. Checks can use digital identification, a commercially reasonable method based on transaction data, or a method approved by Iowa's attorney general. Bona fide news and public-interest content, along with qualifying news organizations, are exempt. Qualifying access-only providers, search engines, and cloud services are exempt when they neither control nor create the content. Users face no liability under this law; providers also face none solely for connecting users to content outside their control.
Privacy protections for users facing age checks
Beginning July 1, 2026, anyone performing these age checks, including hired third parties, must protect users' identifying information. They cannot keep, sell, lease, or share it unless a law or court order requires it. They must also use reasonable security measures for all data collected or sent during verification. Those measures must fit the scope of their business.
Penalties for operators skipping age checks
Beginning July 1, 2026, Iowa's attorney general can sue violators and seek court orders to stop violations. Each user access to a noncompliant site or app counts as a separate violation, carrying a penalty up to $1,000. Penalties against one person cannot exceed $10,000 in a single day. Collected penalties go to Iowa's general fund. The attorney general must also adopt rules to carry out and enforce the law.
