Clear rules for gift card crimes

Beginning 07/01/2025, the law defines key terms for gift card crimes. It explains who is a cardholder, card issuer, and gift card seller. It covers physical and digital gift cards and unique redemption information. It defines value as the greatest possible loss, including the full face value or maximum load for variable cards.

Tougher penalties for gift card fraud

Beginning 07/01/2025, Iowa sets clear crimes and penalties for gift card theft and fraud. Taking or keeping a gift card or its redemption code without consent, with intent to defraud, is an aggravated misdemeanor. Altering or tampering with a gift card to defraud is also an aggravated misdemeanor. Lying or using a scheme to get cards or codes is punished by value: over $5,000 = Class C felony; over $1,000 to $5,000 = Class D felony; over $500 to $1,000 = aggravated misdemeanor; $500 or less = serious misdemeanor. Using a card or code that was unlawfully obtained to get money, goods, or services carries the same value-based penalties. Prosecutors may add up the value of retail goods taken within any six-month period to set the charge.
