Felony for inmates who throw bodily fluids

Beginning July 1, 2025, inmates face class D felony charges for assaults that cause staff contact with bodily fluids. If a person in jail or a state corrections facility causes an employee to contact blood, semen, urine, saliva, or feces, it is a class D felony. It is also a class D felony to intentionally spit or cast those fluids on an employee to cause pain, injury, or insult.

Tougher penalties for assaults on public employees

Beginning July 1, 2025, Iowa increases penalties for assaults on certain public employees. It covers police, jail and corrections staff, parole staff, certain health and state agency workers, on-duty National Guard, and fire staff. If the attacker knows the victim’s role and intends serious injury, or uses or shows a dangerous weapon, it is a class C felony. If the assault causes bodily injury or mental illness, it is a class D felony. Spitting or forcing saliva on these workers is an aggravated misdemeanor, with a mandatory 7 days in jail that cannot be suspended.
