3% retainage cap on public projects

Beginning July 1, 2025, public owners can withhold at most 3% from each monthly payment on public improvement contracts. Payments are based on monthly estimates set by the project architect or engineer. Contractors may retain no more than 3% from each payment to a subcontractor, and must follow any lower limit in the subcontract. The withheld money is a dedicated fund to pay claims for labor and materials on the job.
