The law requires counties with a state regents main campus to elect supervisors from districts (plan three). If such a county was not using plan three on April 10, 2025, it must use plan three for the 2026 general election (an unofficial supervisor election). The county must form a temporary redistricting commission by the later of 30 days after April 10, 2025 or May 15, 2025, and submit a precinct plan by October 1, 2025. The Legislative Services Agency publishes the district plan by January 1, 2026. Voters then use those districts in 2026.
In counties with 60,000 or more people that elect by district (plan three), changing to plan one or two now needs at least two-thirds of ballots cast. This supermajority rule does not apply to counties required to use plan three because they contain a regents main campus.
Vacancies are filled by special election in counties with 125,000 or more people, or in any county with a regents main campus. Smaller counties without a campus may fill vacancies by appointment by the committee of county officers. If more than 70 days remain in the term after the next general election, the office is filled at that election unless a special election was called more than 73 days before the primary. If an appointment is made 88 or more days before the primary and no petition for a special election is filed within 14 days, party candidates are nominated at the primary. These rules also apply when the board declares a vacancy with 2.5 years or more left.
Special elections to change a county’s supervisor plan now happen in November of odd-numbered years (first Tuesday after the first Monday). To get on the ballot, petitions must be filed by June 1 of that odd-numbered year. Existing public notice rules continue (weekly for three weeks, with the last notice 4–20 days before the vote). If the change requires new districts, the temporary redistricting commission must finish and submit the map by December 31 after the election. The new map takes effect January 1.
