Beginning July 1, 2025, Idaho agencies have 21 days to grant or deny certain nonresident public-records requests. This applies to nonresidents who are not employed by an Idaho resident. When staff need more time to find or retrieve records, agencies must give written notice and provide records within 35 days. Residents keep the 3-working-day response deadline and 10-working-day deadline for providing records when extra time is needed. A resident generally must have a permanent home in Idaho for at least 30 continuous days. Full-time students who are residents of another state are excluded; qualifying Idaho-based entities also count as residents. If electronic-format conversion cannot finish on time, agencies must give written notice and provide records at a mutually agreed time. Missing the applicable response deadline counts as a denial. Written notices of full or partial denials must state the legal basis, appeal rights and deadlines, and whether an attorney reviewed the request or was consulted.
