Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Broader eligibility for special prosecutor appointments

Beginning July 1, 2025, special prosecutor eligibility follows judicial-circuit boundaries rather than county boundaries. A prosecutor or deputy from another judicial circuit can serve with their consent. A senior prosecutor can return to a former circuit only when the court finds no appearance of impropriety. Appointees have the circuit prosecutor’s powers, limited to the case or grand jury matter assigned.

Prosecutor reviewers get no expense reimbursement

Beginning July 1, 2025, Indiana Prosecutor Review Board members receive no state reimbursement for travel or other board-duty expenses. Members bear those costs without state reimbursement.

New prosecutor reviews and reviewer protections

Beginning July 1, 2025, a five-member Indiana Prosecutor Review Board oversees prosecutors’ refusals to enforce state criminal laws. It must investigate reports of public blanket refusals and may investigate patterns of refusal. Blanket refusals exclude case-by-case decisions and decisions required by federal law, court orders, or professional-conduct rules. Prosecutors receive notice and have 15 days to respond. Findings of noncompliance go to the Prosecuting Attorneys Council of Indiana and the prosecutor. Board members are protected from civil liability for official acts tied to these investigations and reports.
