Beginning July 1, 2026, the law defines wakeboarding and wakesurfing. You are wakeboarding when you ride a short board, with or without bindings, towed by a motorboat. It also covers a boat operator who tows or plans to tow a rider. You are wakesurfing when you surf a boat’s wake, with or without a tow rope. It also covers a boat operator who makes a wake for someone to surf.
Beginning July 1, 2026, breaking the nighttime ban is a Class C infraction. Knowingly or intentionally violating section 6 is a Class C misdemeanor. These penalties apply to people who operate boats for wakeboarding or wakesurfing in violation of the law.
Beginning July 1, 2026, wakeboarding and wakesurfing are not allowed on public freshwater lakes between sunset and sunrise. On small lakes, you can do wake sports only during the exact time and day covered by a section 11 speed exemption for that lake. Any section 11 speed‑exemption rule made before July 1, 2026 also applies to wake sports.
