No fail-first for cancer drugs in new plans

Beginning July 1, 2026, plans cannot use fail-first rules for certain cancer drugs. It applies to state employee plans, accident and sickness policies, and HMO contracts established, issued, entered into, amended, or renewed after June 30, 2026. The drug must treat advanced or metastatic cancer or associated conditions, be backed by peer-reviewed evidence, and be FDA-approved. Plans cannot make you fail another drug or prove past failure before covering the drug.
