For HOA rules adopted or changed after June 30, 2026, the HOA cannot ban or restrict child care in a single-family home where the provider lives. If you hold a Class I child care home license, you must live in that home. HOAs may update their documents to allow this. Age‑restricted communities that follow the Housing for Older Persons Act are exempt. Existing HOA permissions for in‑home child care remain, and other child care laws still apply. This takes effect July 1, 2026.
Beginning July 1, 2026, if a budget meeting lacks a quorum, the board may adopt up to 100% of the last budget, or 110% if the governing documents allow it. Within the first five years after the developer’s first sale, boards may adopt up to 110% without a quorum only if the governing documents expressly allow it. After five years, without a quorum, any board‑adopted budget is capped at the lesser of 105% or the Midwest housing CPI increase, and only if the governing documents expressly allow it. Older HOAs that already had a 110% rule keep it until they change their governing documents. New or amended documents cannot extend the 110% rule past the first five years.
Beginning July 1, 2026, sellers of HOA homes must give buyers an HOA disclosure, governing documents, assessment amounts, and a board or manager contact. Do this at least 10 days before closing. The HOA can still enforce its rules even if the seller fails to deliver these. A statement of unpaid assessments cannot cost more than $250. For record requests, the first hour of search is free; after that the rate is capped at $35 per hour, prorated, with a $200 total cap. HOAs and their agents cannot charge extra service fees beyond dues and fines listed in the governing documents.
For HOA rules adopted or changed after June 30, 2026, the HOA cannot ban you from keeping an amateur radio antenna on property you own, rent, or lease. The law uses the federal definition of amateur radio antenna. This takes effect July 1, 2026.
