Temporary insurance for property inherited through deeds

Beginning July 1, 2025, Indiana gives temporary insurance protection to people receiving real property through a transfer on death deed. It covers losses after June 30, 2025, under qualifying Class 2(h) or Class 3(a) policies, excluding commercial property policies. The rule applies regardless of when the policy was created. Recipients take on the insured's rights and duties for their transferred interest, generally for 60 days after death. If the policy expires sooner, protection lasts until the later of its expiration date or 30 days after death. Protection ends earlier when the recipient's own qualifying policy covering the property starts. The rule does not give other deed beneficiaries added rights or erase the deceased owner's duties or liabilities. Deeds signed after June 30, 2025, can include an optional warning that this coverage is temporary and may leave the property uninsured afterward. Omitting or incorrectly stating the warning does not invalidate the deed.
