Asset protections for Indiana long-term care policyholders

Effective July 1, 2025, Indiana must reapply for federal approval of a long-term care partnership program by September 1, 2025. If approved, the state must implement the plan within 60 days of approval. The existing program ends when the new program is fully running. Indiana must publish the approval and both dates in the Indiana Register. The plan must secure explicit federal agreement to preserve asset protections for people who bought qualified policies before the old program ends. These protections let some assets remain uncounted when deciding Medicaid eligibility. They cover policies issued before the plan amendment, even those without tax-qualified status or compliance with federal Deficit Reduction Act standards. Without federal approval, the state must not proceed with the transition. Instead, the Medicaid office and insurance department must study affordability and cost effectiveness of the existing program and federal partnership programs. They must report findings and recommendations to lawmakers electronically by December 1, 2026.
