Beginning July 1, 2026, if you are under 21, you cannot buy, accept for personal use, or carry tobacco products or vapor devices. It is also illegal to have a fake or altered ID to buy these items. You have a defense if you handled the products in the normal course of a job in farming, processing, transport, wholesale, or retail. Violations are infractions.
Beginning July 1, 2026, businesses cannot advertise e‑liquid or vapor products within 1,000 feet of school property. A violation is a Class C infraction. With a prior unrelated judgment for this rule, it becomes a Class C misdemeanor.
Beginning July 1, 2026, retailers and delivery sellers cannot sell, deliver, or distribute tobacco products or vapor devices to anyone under 21. Buying for delivery to someone under 21 is also illegal, and giveaways used to promote a product count as distributing. A sale under this rule happens only when the buyer pays the seller. It is not a defense that the recipient did not use the product. Sellers are not liable unless the under 21 person is cited under section 10.5, except for law‑enforcement stings. No one can be charged twice for the same act under both sections. Civil penalties go to the Richard D. Doyle tobacco education and enforcement fund. Defenses include a valid photo ID showing age 21+, the buyer looked at least 30, or the person handled the product as part of their job.
Beginning July 1, 2026, a tobacco product includes any item with tobacco or nicotine, including e‑liquids, that is meant for people to use and is not FDA‑approved to help quit. The criminal rules use a uniform definition of e‑liquid. A vapor device means a powered vaporizer that turns e‑liquid into inhaled vapor. These definitions give clearer coverage for retailers, makers, and enforcement.
