Harsher sentences for masked crimes

Beginning July 1, 2026, wearing a mask during a crime counts against the offender at sentencing. The law defines a mask as a face covering or device used to hide the person’s identity. Judges can weigh this as an aggravating factor and give a tougher sentence.

New crime for malicious littering

Beginning July 1, 2026, it is a Class A misdemeanor to leave refuse on someone else’s property to make them or their guests fear for their safety. This targets intimidation by littering that is meant to scare the owner, occupant, invitee, or a closely associated family member. The law also says “refuse” uses the same meaning as in Indiana’s littering law (IC 35-45-3-2(b)).
