The War Memorial commission can create a nonprofit to support its work and transfer donated money to it. It can also transfer artifacts, images, and documents to that nonprofit without using certain state property and procurement laws. The nonprofit is audited like a state agency. The law repeals the old rule that required newspaper notices and bonds for commission contracts over $10,000. These changes take effect upon passage.
The Memorial Place commission can run souvenir shops or hire a nonprofit to manage them. It can hire staff and must report yearly to the governor on sales and profits. Profits go to a nonreverting Souvenir Shop Fund, invested by the state treasurer, for upkeep and artifact care. Only sellers authorized by the commission can make or sell items showing the monuments or grounds. These powers take effect upon passage.
Beginning July 1, 2026, the Department of Administration sets statewide purchasing rules and category management. It cannot change rights in existing contracts by rule. Each agency must name a trained purchasing representative; it cannot buy without one. For buys of $50,000 to $150,000, agents must seek at least three quotes mailed seven days before the deadline; highway work is excluded. Starting July 1, 2026, agencies must file an annual procurement plan that matches their budget plan and finish prior‑biennium contracts unless waived.
Beginning July 1, 2026, state contracts must include clear scopes, success measures, and remedies for missed deadlines or overruns. They must also include independent verification and validation or another Department‑approved check. The Department establishes and maintains an independent verification and validation program by June 30, 2026 to review agency contracts and require changes.
