Beginning July 1, 2026, the commission studies how surplus interconnection can help meet demand and keep service safe, reliable, and affordable. It can consult stakeholders and require data from utilities and third‑party facility owners or operators. The commission decides if requested data is confidential. Findings appear in its annual report before October 1, 2027.
Beginning July 1, 2026, the law defines key terms, including “surplus interconnection service.” For integrated resource plans filed after December 31, 2029, each electric utility analyzes using surplus interconnection to meet near‑term capacity and energy needs at utility‑owned sites. The utility checks sites it owns with more than 20 megawatts of potential surplus and may ask third‑party owners for information. A utility may propose using more than 100% of a site’s surplus, so long as total use never exceeds the interconnection amount in the facility’s agreement. For petitions to build, buy, or lease power plants filed after December 31, 2029, the commission considers whether the applicant analyzed and will use surplus interconnection.
