The law puts a constitutional bail question on the 2026 general election ballot and gives the exact wording. The question asks to change Article 1, Section 17 on bail. It says a person charged with crimes other than murder or treason is not entitled to bail when two things are true: the proof is evident or the presumption is strong, and the state proves by clear and convincing evidence that no release conditions will reasonably protect anyone’s safety. The ballot language and submission rules start July 1, 2026, and this section ends July 1, 2027. The constitution changes only if voters approve the amendment.
