Beginning July 1, 2026, if a utility has a website, it must post the project area, expected finish date, how to get info, and a contact. The utility must mail the same details to the county plan commission, which may request a meeting within 30 days. If the county has a website and gets the notice, it must post the project details where people can easily find them.
Beginning July 1, 2026, city-owned water or sewer utilities must send written notice at least 60 days before any purchase offer. This applies when extending mains outside city limits or outside the utility’s service area. The notice must explain the project, that the land may be condemned, how to get details, and that the owner can request a meeting within 30 days. When a written request is made, the utility must offer to meet within 30 days. Certified mailing with a return receipt counts as giving notice. After meeting and notice steps are met, the utility may proceed. The rules do not apply to temporary easements or takings needed to protect health or safety. The law defines which municipally owned utilities are covered and excludes utilities run by a consolidated city.
