Beginning July 1, 2026, people can pay up to $25,000 owed to a minor without appointing a guardian. This applies only if no guardian is appointed and no case is pending. The money can go to the person caring for the child where the child lives, or to a legal custodian. Trustees and plan administrators can also send retirement, life insurance, or employee plan proceeds for a minor to a custodian when no guardian exists.
Beginning July 1, 2026, a trust can last up to 360 years if the trust says this and the trustee can freely sell trust property. When an earlier power is used to create a later power or interest, the later one counts as created when the earlier one was created, unless the document says a different time. This timing rule also covers initial powers in legacy trusts. For lifetime gifts to a trust that give a spouse a limited power, interests from that power count as created when the giver created the spouse’s power.
Beginning July 1, 2026, the chapter on residential real estate service agreements does not cover deals made before March 15, 2024. It also does not cover written deals between a homeowner and a family member, the homeowner’s power of attorney, health care representative, or guardian. These exempt deals may grant an interest or be secured by a lien and are outside that chapter’s consumer rules.
The law creates a temporary Guardianship Code Revision Task Force with 11 voting members and staff support. Appointments are due by July 30, 2026, and leaders are named by July 31, 2026. The task force gives a status report by November 1, 2026; if that has no bill text, it must submit proposed legislation by November 1, 2027. It ends December 31, 2027, and meetings are open to the public.
