Restaurants in a city’s downtown redevelopment or economic revitalization area can get special on‑premises permits. The applicant must be the owner or lessee of the restaurant. The Commission can issue these without the usual quota limits. The initial permit fee is $40,000. You cannot transfer ownership, and the permit cannot move from the location. If the area later loses its designation, you may transfer ownership, but the permit must stay at that site. If business at the location stops for more than six months, the permit reverts to the Commission with no refund. A city may also require a binding written commitment as a permit condition.
The Commission can issue new three‑way permits in several other places: Delphi (up to 2), Warsaw (up to 3), Schererville (up to 3), Lafayette (up to 3), West Lafayette (up to 2), Bloomington (up to 2), and Syracuse (up to 1). In Michigan City, up to eight three‑way permits are available inside the transit development district. Applicants must be the owner or lessee of a restaurant in the required redevelopment or transit district areas.
The Commission may issue up to four new three‑way permits in each of these cities: Whitestown, Lebanon, Zionsville, Westfield, Carmel, Fishers, and Noblesville. Across this group, no more than 24 permits can be active at one time. If permits are revoked or not renewed, the Commission may issue only enough to return to 24. Whitestown also may get up to three more three‑way permits and three two‑way permits. Noblesville also may get up to 10 three‑way permits, issued as 3 in 2024, 3 in 2025, and 4 in 2026. Any unused amount rolls to later years.
