Starting July 1, 2026, community corrections programs are treated as political subdivisions for IC 34-12-3.5 and IC 34-13-3. This updates their legal status and is not a direct funding change.
Beginning July 1, 2026, a county that runs community corrections may set up a trust fund run by the county auditor. All commissary sales from the program go into the fund, and year-end balances stay in the fund. The fund can also receive county appropriations, grants, and gifts. Money can be used only for commissary operations, rehab and education programs, facility work tied to programming, and staff training and equipment. Each year before March 1, the agency must report deposits, spending, and the December 31 balance to the county fiscal body and send a copy to the advisory board. The State Board of Accounts can audit the fund, and the auditor must follow public records and government accounting rules.
