Sponsored By: Gary Byrne (Republican)

Signed by Governor

Summary

Allows the state, a state agency, or a political subdivision (public employer) to be reimbursed for the costs of employing and training a law enforcement officer by a public employer that subsequently employs the officer. Provides that the reimbursement amount decreases over time and is eliminated three years after the officer is certified by the law enforcement training board to act as an officer. Allows a public employer to require, as a condition of hiring, that the individual enter into a contract or agreement to reimburse the public employer for employment and training costs, if the individual is subsequently hired by a private or governmental employer that is not defined by statute as a public employer.

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

Officers face repayment for nonpublic jobs

Beginning July 1, 2025, public employers can require new officers to sign repayment contracts as a condition of hiring. Coverage applies to officers hired after June 30, 2025, who complete Tier 1 basic training and become certified. Repayment applies when an officer voluntarily leaves public employment and takes a nonpublic job. Nonpublic employers include private employers and government bodies outside the law's definition of public employer. Eligible costs include exam and basic training fees, specialized training and nonreusable equipment supplied within one year after certification. They also include the first year's base pay and benefits, or the shorter period actually worked. Repayment is capped at 100% of eligible costs for a nonpublic hire within one year after certification. The cap drops to 66% after one but before two years, 33% from two to under three years, then zero. Before hiring, employers must give written notice stating the law applies, their costs at hire, and the declining repayment schedule. The officer must acknowledge the notice. Contracts are void if the officer fails to complete training and certification or the employer's public-to-public recovery rights end. Agreements signed or renewed before July 1, 2025, remain unchanged.

Public employers share officer training costs

Beginning July 1, 2025, public employers can recover costs when officers voluntarily leave for another public law enforcement job. Coverage applies to officers hired after June 30, 2025, who complete Tier 1 basic training and become certified. Public employers include state and local governments, public colleges, school corporations, charter school governing bodies, airport authorities, and government-owned hospitals. Eligible costs include exam and basic training fees, plus specialized training and nonreusable equipment supplied within one year after certification. They also include the first year's base pay and benefits, or the shorter period actually worked. The new employer pays up to 100% of documented costs for hiring within one year after certification. The cap drops to 66% after one but before two years, 33% from two to under three years, then zero. The officer cannot be charged under this system. The new employer must give written notice within 10 days and pay a valid claim within 120 days. The former employer generally must claim within 30 days after notice and before three years after certification. Recovery rights end after a layoff, termination, or missed claim deadline. Separate repayment contracts are excluded, and agreements signed or renewed before July 1, 2025, remain unchanged.
