Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 1 costs, 0 mixed.

Fewer audits for smaller watershed districts

The law raises watershed conservancy districts' annual-audit threshold from $750,000 to $1 million. Districts must get annual audits if they receive or spend at least $1 million in any year. Otherwise, they must get an audit once every four years. Districts pay the audit costs.

Federal training exception for protected farmland

The PACE board can approve structures, roads, or paths on restricted conservation land above an existing underground federal training facility. The construction must serve federal personnel training. Applicants need supporting federal agency documents and county fiscal court consent. They must agree in writing to follow the board's requirements. The agreement must require removal and restoration to the land's previous condition by a set date, to the board's satisfaction.

Conservation districts must follow oversight rules

Soil and water conservation district supervisors must follow Kentucky's special-purpose government oversight rules in KRS 65A.010 through 65A.090. KRS 65A.030 does not apply to these districts. Watershed conservancy districts must also follow the applicable oversight requirements.
