County clerks can correct marriage applications or licenses after both spouses sign an affidavit, a sworn written statement. The clerk must be in the county where the license was issued or recorded. Corrections cover misspelled spouse names or addresses and misspelled parent or witness names. They also cover missing witness, marriage county, or officiant details. Incorrect job information, marriage dates, birth locations, and parent information can also be corrected. Spouses can still seek a corrected license through a court order, including when otherwise required by law.
County clerks must send the domestic violence shelter fund $10 collected from issuing or amending marriage licenses. Payment for the previous month's collections is due by the 10th day of each month. The law expands the covered collections to include amended licenses. The supplied text does not establish a $10 charge per license.
Anyone who intentionally makes an important false statement in a marriage correction affidavit faces penalties under KRS 523.030. The supplied text does not list the penalties.
