Kentucky’s vocational rehabilitation office must favor services provided in Kentucky. That preference cannot effectively deny someone a necessary service that may be available outside Kentucky. The director also has authority to make agreements with other states to serve their residents. The director must establish and oversee small businesses run by eligible people with severe disabilities. The director must also establish state-funded special vocational rehabilitation programs within the agency.
Kentucky’s vocational rehabilitation director must adopt rules for services, staff, administration, service fee agreements, and service fees. Fee rules cover individuals and public or private entities, subject to exceptions in KRS 151B.190. Revised procedures and standards for service fee agreements must be set before the new fiscal year. The law sets no fee amount or increase. The director can obtain liability insurance or an indemnity bond covering driver negligence when office vehicles transport applicants or clients. Transportation contractors must carry coverage in amounts the director sets. Coverage must come from Kentucky-authorized insurers or sureties and pay final judgments for property damage, injury, or death, within policy limits. The director can use Social Security reimbursement receipts for incentives for staff who directly deliver services. Incentives require reimbursement of case service costs for placing Social Security or Supplemental Security Income recipients in qualifying work. That work must reach the federal Substantial Gainful Activity earnings level for nine months and satisfy federal reimbursement criteria. Annual reports must go to the Governor and Legislative Research Commission, with complete operating and financial statements. The commission refers them to the Families and Children and Economic Development and Workforce Investment interim joint committees.
