Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Workers protected from suspicion-only fraud firings

An employee or contractor cannot be terminated under this law’s fraud provision based on suspicion alone. Termination requires a legal finding of guilt that meets the evidence standard and burden of proof in KRS 500.070. This protection applies to termination under this provision, not all firings.

Mandatory referrals for suspected unemployment fraud

Kentucky’s unemployment cabinet must refer suspected fraud involving benefits obtained or sought under Kentucky, another state’s, or federal unemployment law. Referrals go to the Kentucky Justice and Public Safety Cabinet and the appropriate county attorney or Commonwealth’s attorney. When applicable, they also go to the U.S. Department of Justice. The deadline is 30 days after the cabinet determines suspected fraud occurred. Referrals must name the applicable employer, employee, claimant, and name used in the suspected fraud. They must include available contact details for the suspected actor and all fraud-related information filed with or reported to the cabinet.
