Louisiana expands damage claims for people who already qualify to sue as non-user victims under its drug-liability law. They can seek damages from someone who sells, gives, or administers a consumable hemp product to someone under 21. The law also classifies consumable hemp as an illegal controlled substance when its possession or distribution violates state hemp laws.
Louisiana bars claims under this law for harm from consumable hemp use in three situations, unless the injured person is a minor. The first covers claims based only on a processor, wholesaler, or retailer lacking an active permit. The business must have held a valid permit when applying to renew, with renewal still under review when the alleged offense occurred. That review must be with the Louisiana Department of Health or the Office of Alcohol and Tobacco Control. Claims are also barred if the health department approved the product when the incident happened. The same bar applies if approval was revoked no more than 60 days before the incident.
