Stronger carbon storage safeguards and penalties

Louisiana owners or operators of permitted Class VI carbon storage wells must report releases within 24 hours. The same deadline applies to equipment failures that could release stored carbon dioxide. Reports must give the exact location, incident details, and cause when possible. They must describe risks to public health, water sources, and land stability, plus immediate response steps and a repair timeline. Operators must keep required records and share reports with affected local responders, law enforcement, and officials. Reports must also reach the public through an official press release, and the department must post them online. Maximum civil penalties rise from $5,000 to $200,000 for each violation, for each day it continues. Penalties apply when a person misses a compliance order's correction deadline or the commissioner finds a violation, including reporting or recordkeeping failures. The commissioner can also suspend or revoke the violator's permits, compliance orders, licenses, or variances.
