4 provisions identified: 3 benefits, 1 costs, 0 mixed.
The law removes an exception to the vehicle-tracking ban when a vehicle owner has a protective or temporary restraining order. The exception also does not apply when a court grants another person exclusive use of the vehicle. These limits protect people covered by those court orders.
Survivors of domestic abuse, sexual assault, or stalking can ask vehicle makers to suspend remote vehicle access. A complete request needs a certified protective or temporary restraining order, or evidence of abuse signed by a judge or comparable official. Survivors must also show an ownership interest or a certified court judgment granting exclusive vehicle use. Makers that can disable access must act within two business days; suspension lasts for the applicable order or judgment. After a complete request, makers cannot charge survivors a fee, require payment of the abuser’s fines, or contact the abuser. Makers must post a clearly visible website link titled “HOW TO DISCONNECT REMOTE VEHICLE ACCESS.”
Vehicle makers that violate the remote-access requirements face civil fines of $10,000 per violation, capped at $1 million total. Louisiana’s attorney general can sue to collect. After the required Bond Security and Redemption Fund allocation, fines go into the new Survivor Empowerment Fund. The fund also accepts state funding, grants, gifts, and other money; no funding amount is guaranteed. Spending requires legislative approval through the Louisiana Commission on Law Enforcement and the Administration of Criminal Justice. Money supports victims under the Victims of Crime Act and Violence Against Women Act, with commission rules adopted through the Administrative Procedure Act. Unspent money stays in the fund; investments follow general-fund rules, but interest goes to the general fund.
Vehicle makers are not liable for claims arising from their technological inability to disable remote access. This protection also covers their officers, directors, employees, vendors, and agents. These parties are also shielded from claims an abuser brings over actions taken under this law.
