Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

Tighter checks for Louisiana Medicaid eligibility

Louisiana must make its own Medicaid eligibility decisions, though it can use assessments from the federally run health insurance exchange. State Medicaid agencies cannot rely only on automatic renewals unless federal law expressly requires it. The health department must withdraw federal waivers allowing automatic eligibility decisions or renewals by January 1, 2026. For applications and renewals, the department cannot accept a person's statement alone as proof of Louisiana residency, unless federal law requires it.

More Medicaid data checks and safeguards

Louisiana must arrange regular Medicaid data checks, as allowed by law, and cannot seek permission to skip periodic income checks. Monthly reviews cover vital records, including deaths, and Social Security disability status. Quarterly reviews cover workforce wage and job records and motor vehicle residency records. Tax records are reviewed twice yearly for income, wages, or residency changes; an incarceration-checking system must provide reviews at least yearly. The department can use technology and shared government data to check income, residency, household members, and other coverage. It can also buy an income-checking system that detects missing income in real time and prevents counting overlapping records twice. At least quarterly, the department must post public reports without confidential or personally identifying details. Reports must count fraud or intentional-violation investigations and prosecution referrals to the attorney general, and report improper payments, spending, and recovered money. They must also show improper payments and ineligible recipients as percentages of cases investigated and reviewed.
