Beginning January 1, 2026, new standards govern small-employer health stop-loss insurance, applying to policies issued after that date. Policies already in effect before that date are exempt. Renewal increases generally cannot exceed the prior plan year's medical-care index change plus 50%; increases over 50% need actuarial justification. Contracts must last at least 12 months with guaranteed rates. Rates can change during the contract only if plan benefits change or covered worker numbers change by more than 15%. Policies must include an individual claim threshold, an overall claims threshold, or both, before stop-loss coverage pays. Coverage limits and exclusions, including annual limits, must match the employer's health plan unless other employer insurance covers the difference. Policies must pay eligible claims incurred during the contract and paid within 24 months after it expires. Eligible claims remain covered if the employer ends the health plan early, subject to the contract's minimum claim thresholds. For employers with fewer than five workers, policies cannot allow member-specific deductible or claim-threshold adjustments, including adjustments for specific diseases or conditions. Employers must sign a separate disclosure before buying coverage, explaining coverage limits, employer risks, and how claims affect renewals. Louisiana's insurance commissioner must develop the standard disclosure form by January 1, 2026.
