Health coverage protections for district attorney retirees

Beginning August 1, 2025, Louisiana insurers cannot deny enrollment to qualifying district attorney’s office retirees based on retirement status. The insurer must maintain a group health policy held by the office, and the retiree must have had coverage through that office. Retirees must not yet qualify for Medicare, and the office must receive local sales and use tax funding dedicated to its operations. Insurers cannot discriminate between active employees and retirees based on that status. Offices can still limit coverage to active employees, and insurers can follow the office’s eligibility decisions. Insurers can also apply lawful coverage denials that apply to active employees, without offering retirees better terms, rates, or benefits.
