Undo coerced property deals for seniors

If a court finds undue influence over an elderly dependent person, it lets that person avoid the transfer or guaranty. The court can cancel or change deeds and other papers, create a trust, block use or entry, and order the property returned. The court also refuses to enforce any contract to transfer the property or any guaranty tied to that undue influence. The court must award reasonable attorney fees and costs, paid by the wrongdoer or a transferee who paid less than full value.

Good-faith buyers and lenders keep rights

The law protects later good-faith buyers and lenders who gave value. Their title, mortgage, or security interest stays in place even if the court grants relief on the earlier transfer. A mortgage remains valid up to the value the lender provided. These limits can reduce how much property the elderly person can get back.
