Lewiston-Auburn sewer authority, 7-member board

The law creates a nonprofit regional authority to run sewage treatment for Lewiston and the Auburn Sewerage District. It operates, maintains, and improves treatment plants and related facilities, and can use the name Lewiston Auburn Clean Water Authority. A seven-member board governs it: the Lewiston Public Works director; the Lewiston City Administrator or a designee; the Auburn Sewerage District superintendent and president; and the Auburn City Manager or a designee. The Mayor of Lewiston also appoints a Lewiston voter for a 2-year term, confirmed by the city council. If the Auburn Sewerage District president declines or leaves, that president selects a trustee or Auburn resident to serve, subject to confirmation by the Trustees, and the clerk gives written notice to the board. If the Lewiston appointee or the Auburn appointee moves away, dies, or is incapacitated, a successor is chosen to finish the term by the Lewiston Mayor and Council or by the Trustees, as applicable.

Daily fines for industrial sewer violations

Industrial users that break pretreatment rules can be fined up to $1,000 per day for each violation. The board must follow the Maine Administrative Procedure Act, and decisions are reviewable in Superior Court. The authority can set rules for notice, assessment, collection, and enforcement. If the board uses these administrative fines, the authority does not also seek civil money penalties under Title 38, section 1046(1). The authority can still ask a court to order a stop to violations.
