The park owner must send a certified sale notice to each resident and to the Maine State Housing Authority. The owner cannot give final, unconditional acceptance until the 60th day after the authority gets the notice. The notice must say residents have a first option to buy and include the price and terms or the signed acceptable offer; portfolio deals must show park-specific price and terms. A resident group or association can submit an offer by day 60 if at least 51% of occupied homes support it and it includes a purchase and sale agreement. If the group matches the price and equal or better terms, the owner must negotiate in good faith; no nonrefundable deposit is required, and a financing contingency alone is not a reason to reject. After acceptance, the group has a commercially reasonable time to get financing and must close within 90 days of signing, unless both sides agree to more time; if the group fails to finance or close on time, the owner's duties under these rules end for that sale. These rules also apply to any later offer with different price or terms.
A resident group with the purchase option can assign that right by a majority vote. They may assign it to the town, the Maine State Housing Authority or a municipal housing authority, or a nonprofit. The new holder must agree to keep the property operating as a mobile home park.
